a driver was struggling to get around a safety barrier near miami. the trailer was stuck, so eventually the driver appears to hit the gas, and the rear wheels get completely ripped off, and the driver kept going anyway despite the damage. a witness said that removing the wreckage took a full day. nfl quarterback dwayne haskins was legally drunk when he was hit and killed by a truck on a florida highway last month. that's the findings of the broward county medical examiner. haskins also tested positive for two anesthetics also used as recreational drugs. moments before he was hit, haskins' wife says he called her to say that he was leaving his car to get gas. a report determined he'd been walking on the road improperly. the truck driver was not charged. in the johnny depp/amber heard defamation trial, another star is set to testify this week as the case winds down. it appears one of the principals will not be a witness for the defense after all. this morning a strategy shift from amber heard's legal team in the $50 million defamation

lawsuit brought by her ex-husband, johnny depp. the lawsuit stems from an essay in which heard claimed to be the victim of abuse. depp's name appeared on the witness list monday, but in the end, heard's defense team decided not to call him to the stand. >> calling johnny depp in amber's case would have been a bad choice. there's really nothing he could say that would help her. but johnny's side can call him as a witness, so i anticipate we'll see him back on the stand to finish off his case this week. >> also set to take the stand this week, supermodel kate moss. she dated depp in the '90s and is expected to testify tomorrow in defense of depp after heard claimed he once tried to push moss down a flight of stairs. >> johnny says that never happened and is apparently bringing in kate moss as a witness on wednesday to testify that there was no incident where johnny ever tried to push her down the stairs. >> with the trial nearing its conclusion, legal analysts say heard's defense is facing substantial challenges. >> there's a lot of inconsistency with amber's statements. they just don't add up or make a lot of common sense to me. so of course none of us were

there, and the jury is going to have to determine in this he said/she said dispute what happened, but the evidence does not add up in my mind. >> more witnesses took the stand in heard's defense yesterday, including a surgeon who cast doubt on depp's claim about how his finger was severed during a fight between the couple. but in the court of public opinion, observers say it appears heard may have already lost. the actress has faced widespread backlash on social media. >> it's johnny's allegation that amber has lied about her claims of abuse and has actually used the "me too" movement to get support for these false claims. so if true, she's done tremendous damage to that movement. but we're also seeing that we have to balance the need to protect the victim versus the need of due process for the accused. >> the trial is expected to wrap up friday. coming up, gator invader. the wild scene that played out inside a parking garage. but first, why everyone seems to be going wild over pickleball.

participation up 40% in the last two years alone. >> oh! >> this is pickleball. did somebody say pickleball? ♪ and despite its name, the sport has nothing to do with pickles. >> oh! >> a slight swing and a miss. a strange name. where does it come from? >> so the story that has stuck that i hear over and over is a gentleman who created the sport, his dog was named pickles. former tennis player, and that's where it came from. just a dog named pickles. >> aaron fierstein, pickleball instructor at the 92nd street y new york says pickleball is a really big dill. >> i have a list of over 300 people that want to play here on a semester-by-semester basis. and yesterday we just listed our summer classes, and they sold

out in eight minutes. >> unbelievable. >> yeah. >> you're basically like beyonce when she announces a tour. tickets gone. >> tickets gone. that's it. >> i think you're the beyonce of pickleball. >> you know what? i don't dance as well as her, but yeah, yeah. >> the sport proving popular for so many reasons. who should be playing pickleball? >> i think anybody should be playing pickleball. i have my youngest is a group of 10-year-old boys that want to play to the end of the spectrum, where i had a gentleman yesterday who was 86 and really agile and mobile. so it's a wide range. there's no limit to who can play this sport. >> talk to me a little bit about game play and why you keep coming back. >> well, first and foremost, it's just so much fun. it's like reliving your childhood. i mean we get a little bit intense, but most of the time, there's a lot of laughter and camaraderie. >> essentially a mix of tennis, ping pong and badminton, pickleball is played on an area half the size of a tennis court.

first up, dinking. >> dinking, light rally back and forth. this is a great tool in the sport of pickleball. >> the kitchen. that's the area closer to the net. you cannot be touching the kitchen zone or the kitchen line while volleying a ball. in fact, you can only go in there if the ball bounces within the kitchen first. do we know why it's called the kitchen? >> you got to stay out. it's hot. >> teams of two serve up a wiffle ball, rallying for points until one team reaches 11. but you have to win by two. that serve is lethal. what's the secret to a great serve? >> i have some power. i have some power, and i go for it. >> going for it, check. glad that wall is padded. power, we'll get there. but consider this beginner

pickleballer totally hooked. ♪ okay. so the association of pickleball professionals new york city open gets under way tomorrow at the billie jean king national tennis center. yeah, that's where serena williams plays the u.s. open. but the winner of the pickleball open will win a cool $125,000, you guys. >> sign me up. >> sign me up. it was a ton of fun, a great sport for all ages, all athletic types. i can't recommend it enough. >> so i was going to ask you how easy it was to learn, right? it's not overwhelming in terms of rules. >> no, no. it was super easy to learn, super easy to play. i would -- i can't wait to go back to be honest with you. >> andrew, i'm going to put you on blast. >> okay. >> he was talking about the fact that you don't need to be the most, like -- the person who's the most physically fit does not always win. >> correct. it's the great equalizer because of the rules, especially like the kitchen. you can't just run up and slam the ball down.

good for them. you know goats usually have trouble making friends. you know why, right? >> no, i don't know why. >> because they always butt heads. >> they also eat christmas trees. a lot of people bring them in to like get rid of christmas trees. >> really? >> yeah. >> just right into the living room? >> that's wild. so next, to the wild scene inside a parking garage in charleston, south carolina. >> police were called after this massive alligator was spotted roaming around that garage. it took the combined efforts of eight officers, five of which piled on top of the giant reptile to finally subdue and remove it. >> but did he ever find his car? after officers secured its limbs and deadly jaws with duct tape, it was see ya later for the gator. police say the gator was safely relocated out of the facility, which again was a parking garage. >> and after they taped his mouth shut, it was just awkward. they're just lying on top of each other like, okay. >> now what? >> sergeant, you can get off me now. >> this is in florida? >> no. >> this isn't where i parked my car.

>> no. is it still a dog pile if it's on top of an alligator? >> oh, i like that. he outdid you. next, to an incredible wild whale encounter near seattle, washington. >> a lucky group of people got the chance to see a pod of orcas up close without ever having to leave dry land. >> the killer whale swam within feet of the shore, at one point even dazzled spectators with a few tail splashes and waves of their flippers. a nearby dog also appeared to be entertained. it was spotted excitedly barking and chasing the whale down the shoreline. >> this is amazing. if i ever go on a whale tour, that will be the day none of them are out. finally, speaking of splashes, a bear cub was enjoying a little time of its t g w cghonater. camera in the hot tub on a cabin porch in tennessee. oh, so cute. one thing a bear is going to do. >> can somebody turn the jets on, right? kind of relax. >> un-bear-lievable.
